Article 14 Part III ★ Fundamental Right — Citizen Shield ⚖️ Golden Triangle • Rule of Law

Equality before law

Quick Summary (TL;DR)
Guarantees Equality before the Law and Equal Protection of the Laws: from the Prime Minister to an ordinary citizen, everyone is subject to the exact same law, and the State cannot act arbitrarily.
Article 14 is the cornerstone of the Rule of Law in India and the first pillar of the Constitution's 'Golden Triangle' (Articles 14, 19, and 21). It weaves together two complementary constitutional doctrines: (1) 'Equality before the Law' (borrowed from British common law), a negative concept declaring that no person—no matter how wealthy, politically connected, or powerful—is above the law; and (2) 'Equal Protection of the Laws' (inspired by the 14th Amendment of the US Constitution), a positive mandate requiring that people in similar circumstances must be treated alike.

In 1974, the Supreme Court revolutionized Article 14 in E.P. Royappa by establishing the 'Anti-Arbitrariness Doctrine': 'Equality is antithetic to arbitrariness.' Whenever any government department, police officer, municipal body, or public authority acts whimsically, unfairely, or with bias—whether in cancelling a license, awarding contracts, making arrests, or passing laws—Article 14 empowers the courts to strike that action down immediately.
Immunity from arbitrary police action, selective targeting, or biased investigation
Equal subjection of government officials, ministers, and ordinary citizens to ordinary courts of law
Fair, transparent, and non-discriminatory procedure in government recruitment, exams, and public tenders
Right to demand a reasoned, written order behind any adverse government or administrative decision
Protection against 'Manifest Arbitrariness' in parliamentary or state laws that lack rational purpose
Equal access to public utilities, state welfare schemes, and judicial remedies without VIP favoritism
Right to Natural Justice (Audi Alteram Partem): no citizen can be penalized or blacklisted without a fair hearing
Article 14 forbids class legislation but permits "Reasonable Classification" based on two strict tests: (1) Intelligible Differentia (clear, logical basis for grouping, such as progressive income tax slabs or affirmative action for vulnerable groups), and (2) Rational Nexus with the objective of the law. Diplomatic immunity and constitutional protection for the President/Governors under Article 361 are specific constitutional exceptions.
If a traffic cop lets a politician’s convoy break rules while fining you double, or if a municipality demolishes a shop without a show-cause notice, or if a government exam changes rules mid-way—Article 14 is your constitutional sword against state arbitrariness.
