Article 265

Taxes not to be imposed save by authority of law

Article 265 embodies the historic democratic principle 'No Taxation Without Representation' in just 12 words: 'No tax shall be levied or collected except by authority of law.' Here, 'law' means a statute enacted by Parliament or a State Legislature—NOT an executive circular, departmental notification, municipal whim, or police order. If a government department, municipality, panchayat, or tax officer demands money, cess, toll, or surcharge that is not backed by an enacted statute, or collects tax beyond the statutory limit, Both the levy and the collection are unconstitutional under Article 265, and the citizen has a constitutional right to a refund (Mafatlal Industries v. Union of India, 1997).

Persons not to be deprived of property save by authority of law

Originally a Fundamental Right under Articles 19(1)(f) and 31, the Right to Property was repositioned by the 44th Constitutional Amendment Act (1978) into Article 300A under Part XII. However, the Supreme Court has repeatedly affirmed (in Vidya Devi 2020 and Kolkata Municipal Corporation v. Bimal Kumar Shah 2024) that Article 300A is not a dead letter—it is both a powerful Constitutional Right and a fundamental Human Right. 'Property' under Article 300A includes not just ancestral land, flats, and shops, but also movable property (cars, two-wheelers, phones), intellectual property, bank deposits, and hard-earned retirement pensions/gratuity (State of Jharkhand v.
